Assumption of Risk: I understand and acknowledge that participation in the Event, which may include running, walking, jumping, climbing, or other physical activities, involves inherent risks including, but not limited to, physical exertion, musculoskeletal injuries, cardiovascular complications, slips, trips, falls, collisions, dehydration, heat exhaustion, and other potential hazards associated with outdoor events. I acknowledge that participation in such an event carries the risk of serious injury or death, and I voluntarily assume all such risks, known or unknown.
Medical Acknowledgment: I certify that I am in good physical health and have no medical condition, impairment, or ailment that would prevent me from safely participating in the Event. I further affirm that I have either had a recent physical examination or have my physician’s approval to engage in aerobic and/or anaerobic exercise, including activities related to the Event.
Release and Waiver of Liability: I, on behalf of myself, my heirs, executors, administrators, personal representatives, and assigns, hereby fully and forever release, waive, discharge, and hold harmless Humble Independent School District (Humble ISD), Atascocita High School, AHSMCJROTC Booster Club, MCJROTC Instructors, all Event sponsors and donors, volunteers, affiliated organizations, and all employees, officials, officers, directors, agents, and representatives of any of the foregoing entities (collectively, the “Released Parties”) from any and all claims, demands, damages, causes of action, liabilities, or losses of any kind, whether in law or equity, arising out of or related to my participation in the Event, including but not limited to personal injury, illness, disability, property damage, or death, whether caused by the negligence of the Released Parties or otherwise.
Indemnification: I further agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or in connection with: (i) my participation in the Event; (ii) any claims brought by third parties arising out of my conduct; or (iii) any breach of this agreement.
Photography/Media Release: I grant permission to the organizers and their affiliates to use photographs, video, and/or audio recordings of me taken during the Event for promotional, commercial, or any other lawful purposes without compensation or further notice.
Severability: I agree that this Waiver and Release is intended to be as broad and inclusive as permitted by applicable law. If any portion of this agreement is held to be invalid or unenforceable, the remainder shall continue in full legal force and effect.
Governing Law: This agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.
